Summary

This course covers an overview of common intricacies of trust
litigation. Attendees will explore litigation strategies, legal remedies, and
recent case law, gaining practical knowledge essential for effectively
navigating trust disputes. Ideal for general civil litigators who want to “up
their game” and learn some technical tips specific to trust litigation.
Learning Objectives:
o Understand California Trust Law Updates and
Consequences: Attendees will learn important updates in case
law which will enable them to identify issues, and avoid pitfalls
often missed or overlooked.
o Evaluate Trust Disputes: Attendees will be able to identify and
assess common trust disputes, such as breach of fiduciary duty,
trustee misconduct, and contested trust distributions, and trust
contests.

Apply Litigation Strategies: Attendees will develop and apply
effective litigation strategies, including discovery, mediation, and
trial preparation, to resolve trust-related disputes in California
probate courts.
o Evaluate Fiduciary Duties: Attendees will evaluate the legal
obligations of trustees, including the duty of loyalty, prudence,
and impartiality, and determine when a breach has occurred.
o Develop Legal Remedies: Attendees will be able to recommend
appropriate legal remedies for beneficiaries or trustees involved
in trust litigation, including damages, removal of trustees, and
surcharge claims, injunctive relief, and constructive trusts as well
as identify those damages that are often overlooked.
