Summary

There have been sweeping changes to Medi-Cal in the past few years
that have an impact on estate planning and on special needs trusts. In
particular, the elimination of asset limits for Medi-Cal only beginning this
year will have important implications for estate plans and certain special
needs trusts.
Learning Objectives:

1. Distinguish between Medi-Cal only benefits and SSI-based Medi-Cal
benefits.
2. Identify strategies still available to avoid spousal impoverishment.
3. Identify the reasons for using special needs trusts when asset limits
no longer pose a barrier to Medi-Cal eligibility.
4. Analyze hypothetical situations to suggest appropriate strategies to
preserve Medi-Cal benefits.
