Summary

Course Description/Goals:
This program will examine the ethical and practical requirements governing attorney fee agreements under California law, including how to draft rule-compliant engagement agreements for hourly, flat-fee, and contingency representations. The presentation will also address common pitfalls in modifying existing fee agreements, communication and disclosure obligations,
and best practices for ensuring enforceable and ethically sound billing arrangements throughout the attorney-client relationship.
 

Learning Objectives:
? Identify the ethical and statutory requirements governing attorney fee agreements under California law, including when written fee agreements are required.
? Distinguish between hourly, flat-fee, and contingency fee arrangements, including the unique disclosure, trust accounting, and communication obligations applicable to each.
? Analyze the rules and ethical considerations implicated when modifying an existing fee agreement during the course of representation.
? Recognize common drafting errors and billing practices that may render a fee agreement unenforceable or create potential disciplinary exposure.
? Apply best practices for preparing clear, enforceable, and rule-compliant fee agreements that promote effective attorney-client communication and reduce fee disputes.
