Summary

Course Description/Goals:
California finally has a virtual representation statute! But what does that mean, exactly? And how can it be useful to our practice? This presentation begins with a discussion of what virtual representation is and why California needs it. The presenters will then review the new statute in detail and will discuss its practical applicability and its possible pitfalls. The presenters will also explore how to logistically use the new statute, including incorrect usage and the resulting consequences.
 

Learning Objectives:
o Understand California’s new virtual representation rules
o Identify situations appropriate to use virtual representation, and be able to analyze risks in doing so
o Know how to document use of virtual representation in notices and consents
