Summary

Course Description/Goals:

Preparing your client(s) before mediation to prevent settlement roadblocks
? Utilizing the mediator before mediation to address discreet issues such as
conflicts between the attorney and the client/decisionmaker
? Resolving potential conflicts between attorneys and their clients
? Preparing your approach/communication style with the other side to break
through communication barriers which may become barriers to resolution
? Selecting the mediator and determining the timing and length of the session
? Preparing the mediation brief and sharing information before and at the
session
? Remaining collaborative when communications break down and emotions
run high
? Cleaning up loose ends due to other persons who may need to ratify/approve
of the settlement achieved at the session
? Maintaining collaborative communication that may ultimately resolve the
dispute should the session result in an impasse
