Appellate Standard of Review

This program is designed for all attorneys who handle appeals. Determining and effectively using the applicable standard of review can have enormous impact on the outcome of an appeal. It is the prism through which the justices view the issues. This class will focus on how to structure your appeal to obtain the most favorable standard of review and how best to work within the correct standard of review.

Highlights will include:

• Framing the issues to obtain the most favorable standard of review

• What to look for to facilitate use of the most helpful standard of review

• Turning a factual issue into a legal issue
