Meal and Rest Break Requirements Clarified Under the Brinker Ruling

Meal and rest period violations have increasingly become a major player in employee claims and class action lawsuits, resulting in large awards of premium wages and penalties.

Finally, the California Supreme Court in Brinker Restaurant vs. Superior Court of San Diego answers outstanding questions on the employer’s duties in providing and timing of meal and rest periods. In addition to addressing meal and rest period requirements, the Brinker decision provides guidance regarding the circumstances where class actions are applicable in common wage and hour claims.

Dawn Ross and Valorie Bader will discuss the Brinker holding with practical applications of common workplace scenarios and the implications on future claims or litigation.

Dawn Ross leads Carle, Mackie, Power & Ross’ employment group and commercial litigation team. Ms. Ross has successfully represented both employees and employers in state and federal litigation and administrative proceedings. Ms. Ross serves as counsel to some of the leading wineries, along with many other clients in the public and private sector. She assists clients in preparing employee handbooks, employment agreements, counseling on layoffs and terminations. In addition to litigating wage and hour, wrongful termination and discrimination cases, Ms. Ross also acts as trial counsel in intellectual property and commercial litigation matters such as breach of contract, real estate transfers, fraud, trade secret and trademark violations.
