COVID-19 and the Return to Work: Cal-OSHA, Workers’ Compensation, Claims Handling, and Other Employment Pitfalls

This panel discussion via zoom will focus on some of the consequences of bringing employees back to work, and the interplay between Cal-OSHA safety protocols and reporting requirements, California’s Executive Order on 3/19/20 regarding workers’ compensation presumed coverage for employees who contract COVID-19, coverage issues and other implications and outcomes of the Executive Order, and related employee claims.

Ms. Bader has practiced in the areas of employment and business counseling, training, and employment litigation since 1986. Prior to becoming an attorney she worked for Sonoma County Risk Management coordinating workers’ compensation and disability claims. Ms. Bader continues to represent businesses and individuals before administrative agencies such as the Labor Commissioner, the Employment Development Department, the Workers Compensation Appeals Board, Cal-OSHA, the Department of Fair Employment and Housing/Equal Employment Opportunity Commission, CA Department of Licensing, CA Department of Insurance. Her current practice includes sexual harassment training and other trainings, investigations, mediation and arbitration, as well as other alternatives for conflict resolution. Ms. Bader has performed numerous workshops and in diverse topics related to employment issues and has taught specific employment law classes for the Santa Rosa Junior College as well as written extensively in the subjects of employment law, and appeared in the Sonoma Business Journal and the Press Democrat. In addition to her legal work, Ms. Bader chairs the Employment Law section of the Sonoma County Bar Association.

Ms. Hernandez has been a Senior Partner at Mullen in Filippi since 1997. She has been the Managing Partner of the Santa Rosa office since 2002.

Anne Hernandez grew up in rural upstate New York and attended SUNY at Oswego. She spent one year at UCLA and realized snow was not the way to go. Vowing never to shovel the driveway again, she attended Loyola Law School in Los Angeles and has been firmly planted in California ever since. Anne started her legal career as a public defender in Los Angeles. After 5 years of defending the downtrodden, she moved to Santa Rosa for a sea change in her profession to Workers Compensation. Anne, Santa Rosa, and Worker’s Compensation proved to be a perfect fit.

Ms. Hernandez has 2 favorable published Court of Appeal decisions to her credit. The Hutton case helped define causation percentages for psychiatric injuries.
Always with her eye on the workers’ compensation community she started the Northbay Workers’ Compensation Association in 1994. She is the
current legal advisor to COSIPA and participates in seminars throughout California.

Anne is grateful and amazed that she still learns something new every day practicing workers’ compensation.
Anne has relatives she likes living in Jackson Wyoming. The Tetons are one of her favorite places. She enjoys her dogs, kids, and just about any
adventure.

Ms. Nancy Price-Cort is a lifelong insurance professional with over 30 years’ experience serving the business insurance needs of her clients in variety of industries including construction, transportation, manufacturing and Property Management. She has worked for national brokerage operations including Marsh & McClellan and large regional brokerage houses, among them ABD Insurance Services. Starting with the Don Ramatici Insurance team in 2001, she has happily helped her customers manage their insurance risks for the past 18 years. After earning her Certified Insurance Counselor designation in 1990, and Certified Professional Insurance Woman designation in 1991, she also completed her Certified Risk Manager designation in 2008. Don Ramatici Insurance named her Vice President of Sales in 2015 and she serves actively on their Board. She is also the Secretary for the North Bay Workers’ Compensation Association.

Nancy is a self-proclaimed “insurance geek”, but enjoys many hobbies including cooking, especially baking, hiking or almost any outdoor activity, and travel.

Ms. Prince has represented employers in OSHA and Cal/OSHA matters for more than seventeen years. Lisa was a partner at Walter & Prince LLP before starting her own firm. The Prince Firm represents employers ranging from Fortune 500 companies with thousands of employees in many states to local small businesses and every size in between. The firm focuses on all aspects of the California Occupational Safety and Health Administration [Cal/OSHA] including advocacy during rulemaking, compliance assistance, management of enforcement activity and appeal of citations. She presents an annual update on the law for several safety groups.
Lisa lives with her wonderful husband and partner in all things, amazing daughter, and Mila the Magnificent. (Mila is a mutt but finds the term pejorative; she prefers to be called a “Canine-American Hybrid.”) In her spare time, Lisa strives for a perfect garden and a perfect manicure. She has achieved neither.
