Federal Trade Secrets Act

Congress has enacted the Defend Trade Secrets Act of 2016, for the first time creating a federal cause of action for trade secret misappropriation. The federal cause of action differs from California’s existing Trade Secrets Act, meaning that practitioners must now decide whether to file under the California or federal statute. This seminar will examine the differences between the two statutes, and some of the strategic considerations in deciding the best forum under the particular circumstances.


Ross Jones

Mr. Jones is a partner in the firm of Merrill, Arnone & Jones, a premier Sonoma County Law Firm based in Santa Rosa. He has over three decades of experience as an attorney, focusing on the areas of intellectual property, business counseling, employment, and complex litigation. Mr. Jones has represented clients in trade secret litigation and counseling in a wide variety of industries, including telecom, biotech, food manufacturing, agriculture, and professional services. He received his JD from the University of San Diego in 1985 and was admitted to the State Bar of California shortly thereafter. He has served as past Chair of the Sonoma County Bar Association’s Intellectual property and Technology Law section.

Edward S. Sherman

Dr. Sherman is a Registered Patent Attorney based in Santa Rosa. He has over 15 years’ experience in patent preparation and prosecution, and the related areas of copyright, trademark, trade secret law and licensing transactions. He is also the part time Patent Counsel for Meyer Corporation. He previously worked is science and engineering at several Bay Area technology companies and as the Intellectual Property Manager for JDS Uniphase in Santa Rosa. He received his J.D. from Empire College and his Ph.D. in Polymer Science and Engineering from the University of Massachusetts, Amherst.
